PHÒNG TUYÊN TRUYỀN VÀ THEO DÕI THI HÀNH PHÁP LUẬT
I. Vị trí, chức năng của Phòng Tuyên truyền và Theo dõi thi hành pháp luật
Phòng Tuyên truyền và Theo dõi thi hành pháp luật là phòng chuyên môn, nghiệp vụ thuộc Sở Tư pháp, chịu sự quản lý chỉ đạo toàn diện về tổ chức và hoạt động của Giám đốc Sở Tư pháp, có chức năng tham mưu, giúp Giám đốc Sở thực hiện quản lý nhà nước về công tác phổ biến, giáo dục pháp luật; hòa giải ở cơ sở; tủ sách pháp luật; xây dựng xã, phường, thị trấn tiếp cận pháp luật; hỗ trợ pháp lý cho doanh nghiệp nhỏ và vừa và công tác theo dõi thi hành pháp luật.
II. Nhiệm vụ và quyền hạn
Tham mưu cho Giám đốc Sở:
1. Trình Ủy ban nhân dân tỉnh:
a) Dự thảo nghị quyết, quyết định và các văn bản khác thuộc phạm vi thẩm quyền ban hành của Hội đồng nhân dân, Ủy ban nhân dân tỉnh trong lĩnh vực được Giám đốc Sở phân công;
b) Dự thảo kế hoạch dài hạn, 5 năm, hàng năm và các đề án, dự án, chương trình, biện pháp tổ chức thực hiện công tác phổ biến, giáo dục pháp luật; hòa giải ở cơ sở; xây dựng xã, phường, thị trấn đạt chuẩn tiếp cận pháp luật; hỗ trợ pháp lý cho doanh nghiệp nhỏ và vừa và công tác theo dõi thi hành pháp luật thuộc thẩm quyền ban hành của Ủy ban nhân dân tỉnh.
2. Trình Chủ tịch Ủy ban nhân dân tỉnh Dự thảo quyết định, chỉ thị thuộc thẩm quyền ban hành của Chủ tịch Ủy ban nhân dân tỉnh trong phạm vi được Giám đốc Sở phân công;
3. Hướng dẫn, kiểm tra và tổ chức thực hiện các văn bản quy phạm pháp luật, quy hoạch, kế hoạch, chương trình, đề án, dự án đã được cấp có thẩm quyền quyết định, phê duyệt thuộc phạm vi, thẩm quyền quản lý nhà nước về công tác tư pháp được Giám đốc Sở giao.
4. Về phổ biến, giáo dục pháp luật và hòa giải ở cơ sở
a) Xây dựng hoặc phối hợp với các đơn vị có liên quan xây dựng các đề án, chương trình, kế hoạch về phổ biến, giáo dục pháp luật, hòa giải ở cơ sở trình Giám đốc Sở ban hành theo thẩm quyền và tổ chức thực hiện sau khi các đề án, văn bản, chương trình, kế hoạch được ban hành.
b) Theo dõi, hướng dẫn công tác phổ biến, giáo dục pháp luật tại địa phương; đôn đốc, kiểm tra các cơ quan chuyên môn trực thuộc Ủy ban nhân dân tỉnh, các cơ quan, tổ chức có liên quan và Ủy ban nhân dân cấp huyện trong việc tổ chức Ngày Pháp luật nước Cộng hòa xã hội chủ nghĩa Việt Nam trên địa bàn;
c) Thực hiện nhiệm vụ của cơ quan thường trực Hội đồng phối hợp phổ biến, giáo dục pháp luật tỉnh;
d) Xây dựng, quản lý đội ngũ báo cáo viên pháp luật, tuyên truyền viên pháp luật; tham gia với các cơ quan có liên quan thực hiện chuẩn hóa đội ngũ giáo viên dạy môn giáo dục công dân, giáo viên, giảng viên dạy pháp luật theo quy định của pháp luật;
đ) Tổ chức thông tin, tuyên truyền, phổ biến, giáo dục pháp luật về các lĩnh vực thuộc phạm vi quản lý của Sở Tư pháp.
e) Theo dõi, hướng dẫn, cải tiến việc xây dựng, quản lý, khai thác tủ sách pháp luật ở xã, phường, thị trấn, cơ quan, đơn vị, doanh nghiệp, trường học;
g) Hướng dẫn, kiểm tra, theo dõi về tổ chức và hoạt động hòa giải ở cơ sở theo quy định của pháp luật; hướng dẫn nghiệp vụ và kỹ năng hòa giải ở cơ sở cho hòa giải viên theo quy định của pháp luật.
5. Giúp Ủy ban nhân dân tỉnh thực hiện nhiệm vụ về xây dựng xã, phường, thị trấn tiếp cận pháp luật theo quy định.
6. Thực hiện các hoạt động hỗ trợ pháp lý cho doanh nghiệp nhỏ và vừa theo quy định của pháp luật.
7. Về theo dõi thi hành pháp luật:
a) Xây dựng, trình Ủy ban nhân dân tỉnh ban hành và tổ chức thực hiện kế hoạch theo dõi tình hình thi hành pháp luật trên địa bàn;
b) Hướng dẫn, đôn đốc, kiểm tra các cơ quan chuyên môn thuộc Ủy ban nhân dân tỉnh, Ủy ban nhân dân cấp huyện trong việc thực hiện công tác theo dõi tình hình thi hành pháp luật tại địa phương; đề xuất với Ủy ban nhân dân tỉnh về việc xử lý kết quả theo dõi tình hình thi hành pháp luật;
c) Tổng hợp, xây dựng báo cáo tình hình thi hành pháp luật ở địa phương và kiến nghị các biện pháp giải quyết những khó khăn, vướng mắc trong thi hành pháp luật với Ủy ban nhân dân tỉnh và Bộ Tư pháp;
d) Theo dõi tình hình thi hành pháp luật trong các lĩnh vực tư pháp thuộc phạm vi quản lý nhà nước của Ủy ban nhân dân tỉnh.
8. Kiểm tra đối với cơ quan, tổ chức, cá nhân trong việc thi hành pháp luật trong lĩnh vực được Giám đốc Sở phân công.
9. Thực hiện các nhiệm vụ khác theo quy định của pháp luật và theo sự phân công của Giám đốc Sở Tư pháp.
III. Cơ cấu tổ chức và biên chế
1. Phòng Tuyên truyền và Theo dõi thi hành pháp luật có Trưởng phòng, Phó Trưởng phòng và các chuyên viên.
a) Trưởng phòng là người đứng đầu đơn vị, chịu trách nhiệm trước Giám đốc Sở và trước pháp luật về toàn bộ hoạt động của phòng và việc thực hiện chức năng, nhiệm vụ, quyền hạn được giao.
b) Phó Trưởng phòng là người giúp việc cho Trưởng phòng, thực hiện một số nội dung công việc do Trưởng phòng phân công và chịu trách nhiệm trước Trưởng phòng và trước pháp luật về nhiệm vụ được phân công. Khi Trưởng phòng đi vắng, Phó Trưởng phòng được Trưởng phòng ủy quyền điều hành các hoạt động của phòng.
c) Việc bổ nhiệm, miễn nhiệm Trưởng phòng, Phó Trưởng phòng Phòng Tuyên truyền và Theo dõi thi hành pháp luật thực hiện theo quy định của pháp luật.
2. Biên chế của Phòng Tuyên truyền và Theo dõi thi hành pháp luật là biên chế hành chính nhà nước, số lượng do Giám đốc Sở Tư pháp quyết định trên tổng số biên chế hành chính được Chủ tịch Ủy ban nhân dân tỉnh giao.

LAW DISSEMINATION AND IMPLEMENTATION MONITORING DIVISION
I. Position and functions of Law Dissemination And Implementation Monitoring Division
Law Dissemination And Implementation Monitoring Division is a specialized and professional division of the Department of Justice, under the comprehensive management and direction of the Director of the Department of Justice, with the function of advising and assisting the Department of Justice. The Director of the Department performs the state management of law dissemination and education; grassroots mediation; law bookcase; building communes, wards and townships to access the law; legal support for small and medium enterprises and law enforcement monitoring.
II. Duties and powers
Advise the Director of the Department:
1. Submit to the Provincial People's Committee:
a) Draft resolutions, decisions and other documents falling within the promulgation competence of the People's Council or the Provincial People's Committee in the field assigned by the Director of the Department;
b) Draft long-term, 5-year, annual plans and schemes, projects, programs and measures to organize the implementation of law dissemination and education; grassroots mediation; building communes, wards and townships up to standards of legal access; legal support for small and medium enterprises and the monitoring of law enforcement fall under the promulgating competence of the Provincial People's Committee.
2. To submit to the President of the Provincial People's Committee a draft decision or directive within the promulgation competence of the Chairman of the Provincial People's Committee within the scope assigned by the Director of the Department;
3. Guide, examine and organize the implementation of legal documents, plans, programs, schemes and projects already decided and approved by competent authorities within the scope and competence of the competent authorities. The right to state management over judicial work is assigned by the Director of the Department.
4. Law dissemination, education and mediation at grassroots
a) Develop or coordinate with other units related construction projects, programs and plans for dissemination, legal education, reconciliation at grassroots level the Director of the Department issued under the authority and to implementation after the projects, documents, programs and plans are promulgated.
b) Monitor and guide the work of law dissemination and education in the locality; urge and inspect specialized agencies directly under the Provincial People's Committee, relevant agencies and organizations and the People's Committee of the district in organizing the Law Day of the Socialist Republic of Vietnam;
c) Perform the duties of the standing agency of the Provincial Law dissemination and education-coordinating Council;
d) Building and managing a team of law rapporteurs and law propagandists; join with relevant agencies in standardizing the contingent of teachers teaching civics, law teachers and lecturers in accordance with law;
d) Organize information, propaganda, dissemination and education of the law in the fields under the management of the Department of Justice.
e) Monitor, guide and improve the construction, management and exploitation of law bookcases in communes, wards, townships, agencies, units, enterprises and schools;
g) Guiding, examining and monitoring the organization and operation of grassroots mediation in accordance with law; provide professional guidance and conciliation skills at the grassroots level for mediators in accordance with the law.
5. Assist the Provincial People's Committee in carrying out the task of building communes, wards and townships to access the law according to regulations.
6. Carry out legal support activities for small and medium enterprises in accordance with the law.
7 . Regarding law enforcement monitoring:
a) Formulate and submit to the Provincial People's Committee for promulgation and organize the implementation of the plan to monitor the law enforcement situation in the locality;
b) Guide, urge and inspect the specialized agencies of the People's Committee of the province and the People's Committee of the district in carrying out the monitoring of the law enforcement situation in the locality; propose to the Provincial People's Committee on handling the results of monitoring the law enforcement situation;
c) Summarize and develop reports on the situation of law enforcement in the locality and propose measures to solve difficulties and obstacles in law enforcement to the Provincial People's Committee and the Ministry of Justice;
d) Monitor the situation of law enforcement in the judicial fields under the state management of the Provincial People's Committee.
8. Inspecting agencies, organizations and individuals in law enforcement in the fields assigned by the Director of the Department.
9. Perform other duties as prescribed by law and as assigned by the Director of the Department of Justice.
III. Organizational structure and staffing
1. Law Dissemination And Implementation Monitoring Division has a Head, Deputy Head and experts.
a) Head of Division is head of unit, responsible to the director of the department and to the law for all activities of Division and the performance of assigned functions, tasks and powers.
b) Deputy Head of Division is the assistant to Head of Division, performs a number of tasks assigned by Head of Division and is responsible to Head and to the law for the assigned tasks. When Head of Division is away, Deputy Head of Division is authorized by Head to manage the activities of Division.
c) The appointment and dismissal of Head and Deputy Head of Law Dissemination And Implementation Monitoring Division shall comply with the provisions of law.
2. The payroll of the Law Dissemination And Implementation Monitoring Division is the state administrative payroll, the number of which is decided by the Director of the Department of Justice out of the total number of administrative staff assigned by the Chairman of the Provincial People's Committee.
